The High Court recently rejected an application for special leave against the unanimous decision of the Court of Appeal in Tolson v RMS. In Tolson, the Court of Appeal confirmed the long held understanding that an increase in value of the residue land under s 55(f) can offset the compensation payable for market value under s 55(a).
