A Question of Betterment

Nicholas Brunton
Henry Davis York

The High Court recently rejected an application for special leave against the unanimous decision of the Court of Appeal in Tolson v RMS. In Tolson, the Court of Appeal confirmed the long held understanding that an increase in value of the residue land under s 55(f) can offset the compensation payable for market value under s 55(a).

Dr Nick Brunton explores the factual and legal issues that occurred in this case, discuss the key principles that emerge, and highlight what valuers must consider where a situation of betterment may arise.
